1. ELIGIBILITY

This giveaway is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Employees of Backyard Beans Coffee Company and their immediate family members (spouse, parents, children, and siblings and their spouses) and those living in the same household are not eligible to enter or win. Void where prohibited by law.

2. ENTRY PERIOD

The giveaway runs monthly from the first day of each month at 12:00 AM ET through the last day of each month at 11:59 PM ET (the "Entry Period").

3. HOW TO ENTER

To enter, visit https://backyardbeans.com and submit your email address in the giveaway entry popup form. The form will appear automatically when visiting the site, or can be accessed by clicking the giveaway notification on the webpage. You will receive one (1) entry into the drawing by providing your email address. You may receive one (1) additional entry (for a total of two entries) by also providing your SMS phone number.

By entering once, you will be automatically entered into all subsequent monthly drawings until you win or unsubscribe from our mailing list. Previous entrants do not need to re-enter each month. Your entry count (one or two entries, depending on whether you provided SMS) will carry forward to each month's drawing.

You must remain subscribed to Backyard Beans Coffee Company's email list to maintain eligibility. If you unsubscribe from our emails before a drawing takes place, your entry will be voided and you will no longer be eligible to win.

By entering, you consent to receive periodic marketing emails from Backyard Beans Coffee Company. If you provide your SMS phone number, you also consent to receive periodic marketing text messages from Backyard Beans Coffee Company. You may unsubscribe from emails at any time by clicking the unsubscribe link included in each email, and from text messages by replying STOP to any message.

By entering, you also agree that if you are selected as a winner, Backyard Beans Coffee Company may use your first name and last initial for marketing and promotional purposes, including on social media, without further compensation or approval.

4. PRIZE

One (1) winner will receive a Gift Box with two (2) selected coffees. Approximate Retail Value (ARV): $50 USD.

Prize is awarded "as is" with no warranty or guarantee, either express or implied. Winner is responsible for all applicable federal, state, and local taxes, if any. No substitution, transfer, or cash equivalent of prize is permitted. Backyard Beans Coffee Company reserves the right to substitute a prize of equal or greater value in the event the offered prize is unavailable.

5. WINNER SELECTION AND NOTIFICATION

One (1) potential winner will be selected in a random drawing from all eligible entries received during the Entry Period. The drawing will be conducted on or around the last day of each month by Backyard Beans Coffee Company, whose decisions are final and binding. Only entrants who remain subscribed to Backyard Beans Coffee Company's email list at the time of the drawing are eligible to win.

The potential winner will be notified via email at the address provided at entry within five (5) business days of the drawing. The potential winner must respond to the notification email within seventy-two (72) hours of the date and time the notification is sent, providing their full name and mailing address for prize delivery. Failure to respond with the required information by the end of this 72-hour period will result in forfeiture of the prize, and Backyard Beans Coffee Company may, at its sole discretion, select an alternate winner or allow the prize to go unawarded.

If a potential winner is found to be ineligible, has not complied with these Official Rules, has unsubscribed from the email list, or declines the prize for any reason prior to award, the prize will be forfeited and Backyard Beans Coffee Company may, at its sole discretion, select an alternate winner or allow the prize to go unawarded.

Once a participant has won a prize, they will be removed from eligibility for all future monthly giveaways.

6. GENERAL CONDITIONS

By entering, you agree to be bound by these Official Rules and the decisions of Backyard Beans Coffee Company, which are final and binding in all respects. By entering, you agree to release, discharge, and hold harmless Backyard Beans Coffee Company and its officers, directors, employees, and agents from any and all liability or damages associated with acceptance, use, or misuse of any prize or participation in this giveaway.

Backyard Beans Coffee Company reserves the right to modify, suspend, or terminate the giveaway if fraud, technical failures, or any other factor beyond Backyard Beans Coffee Company's reasonable control impairs the integrity or proper functioning of the giveaway.

Backyard Beans Coffee Company is not responsible for lost, late, misdirected, or incomplete entries.

7. PRIVACY

Information collected from entrants is subject to Backyard Beans Coffee Company's Privacy Policy, available at https://backyardbeans.com/pages/privacypolicy. By entering, you acknowledge that the information you submit will be used in accordance with our Privacy Policy.

8. DISPUTES

Except where prohibited, by entering, you agree that any and all disputes, claims, and causes of action arising out of or connected with this giveaway shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state court located in Pennsylvania. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules shall be governed by the laws of Pennsylvania without giving effect to any choice of law or conflict of law rules.
